You are probably feeling angry, confused and a little afraid of what might happen to you. The process of being arrested is dehumanizing and embarrassing and I sympathize with you.
I don’t want to scare you, but you are faced with a very serious charge.
As I am sure you have discovered, if you are convicted of a DWI, you lose your license, your insurance goes up monumentally, and you face the possibility of jail along with other punishments. Additionally, it is a criminal conviction which could cause you trouble in finding jobs, being accepted at schools, trouble with insurance rates, and in many other ways.
I can help you through this challenging thicket. There are many ways to challenge the State in a DWI case. We will discuss and I will raise all possible challenges that might result in a better outcome for you.
I start with the position that you are not guilty.
After you have retained me, I first draft my closing argument as to why you are not guilty. Then I will know the defenses I need to prepare. I will make the State prove their case beyond a reasonable doubt.
I plead not guilty in most cases; I am not afraid of trials. My goal is to have you found not guilty of all charges. I temper that goal with an understanding of the sentencing consequences in DWI cases. I never want to plead not guilty and have my client punished more harshly because of a such a plea and I am often able to avoid additional punishment by being careful about where, when, and how we argue your case.
District Attorneys have a lot of responsibility in DWI cases and are sometimes not well prepared to perform all of the duties required of them because they are accustomed to guilty pleas being entered at an early stage. I can’t promise that you will be found not guilty because each case is different. I can promise that I will leave no stone unturned in my quest to minimize the consequences to you in every way.
When you hire me, you will get my 25 years of experience, my very bright and capable associate, and my excellent staff, all of us working as a team towards the goal of getting you the very best available result. I have a great team, and we are all focused on helping you get through this problem as easily as possible. I will put pressure on the District Attorney’s office to do all of the work that is required of them. DWIs are the most complicated cases in misdemeanor court.
In every DWI case in NC the district attorney has to prove:
As you can see a DWI case is never simple. You need an aggressive and well respected lawyer. You have found that lawyer!
Free consultation - $250 value.
In a DWI case, I charge a flat fee, not an hourly rate; but when I’m charging a hourly rate, my hourly rate is $250 per hour. When you meet with me and my staff, there is no charge for the consultation. We take as long as you need as we explain all the in’s and out’s, all of the possible consequences, and all of the techniques we will use in your case to get you the best result available.
Once you have discussed your case with me and my team, you will know all you need to know about your case and the system in North Carolina. Of course I will follow up with any questions that occur as the process moves along and will keep you informed of any progress we have made. Undoubtedly there will be developments and questions that I can’t discuss at the initial conference, but we will begin preparing your case right then! I begin preparing my case at the first meeting.
To arrange for your consultation call me at my office. You can talk to my staff and arrange a meeting or you can leave a message 24 hours a day. Someone on the team will call you back promptly. I prefer in person consultations. However, I understand that it may be difficult for someone that has been charged with a DWI and has lost their license and particularly difficult for someone who does not live near my office. We will work with you to make that consultation as easy on you as possible (even having phone consults where necessary) while still gathering all of the information that we need to perform at the highest level on your case.
In summary, with my help you will get:
Additionally, if you are charged with a DWI and either:
